Booking Terms and Conditions Please find detailed below our Booking Terms and Conditions - please read these before making a booking. 1. General Northumberland Cottages Ltd (the Company) {Registered Office - 1-3 Sandgate, Berwick Upon Tweed. TD15 1EW Registration No: 05132459} acts entirely as a booking agent arranging bookings and reservations of holiday accommodation as agent for the owner of the accommodation ("the Owner"). 2. Formation of Contract A binding contract between the Holidaymaker (the Holidaymaker) and the Owner shall be entered into on the Company issuing the holiday confirmation form as agent for the Owner. Northumberland Cottages Ltd acts solely in the capacity of a booking agent and are not a party to the contract. On signing the booking form the booking conditions outlined in this document are deemed to have been accepted by the Holiday maker. 3. Payment Bookings and reservations shall be contractual when Northumberland Cottages Ltd receives a deposit of 50% of the rent, the booking fee, insurance premium and issues a confirmation in writing that the booking has been accepted. The balance shall be payable six weeks before commencement of the holiday. If the Holidaymaker books the holiday less than six weeks before the holiday commencement date, the full rental costs and booking fee must be paid prior to the issue of the holiday confirmation. Provisional bookings must be confirmed by payment of a deposit, booking fee and return of completed booking form within 5 working days. Receipt of a deposit shall not constitute acceptance of any booking. All payments shall be made payable to "Northumberland Cottages Ltd" and sent to the Companys address on the Booking Form. Holiday dates can be changed provided the holiday accommodation is available, for the new dates and the Owner is agreeable to the change. A handling charge of 25 pounds plus VAT will be payable. 4. Alternative Accommodation If for any reason it proves necessary for us to make a change to your booking by the unexpected withdrawal of the holiday accommodation by the Owner or for any other reason, the Company will try to arrange alternative holiday accommodation of a similar type and standard. If the alternative holiday accommodation shall not be acceptable to the Holidaymaker the Company shall refund in full all rental monies paid, not including booking fees. The Company shall be under no further obligation or liability in this respect. 5. Cancellation Any cancellation made by the Holidaymaker (for whatever reason) shall be in writing to the Company at the address stated at the top of the Booing Form. If the cancellation is for reasons not covered by cancellation curtailment insurance the Company shall endeavour to re-let the holiday accommodation for the entire period of the original booking. If the Company shall be successful in re-letting the holiday accommodation for the entire period originally booked it shall refund all monies paid less Booking Fee, Insurance Premium and a handling charge of 25 Pounds (plus VAT). If the Company shall only succeed in re-letting the holiday accommodation for a proportion of the period originally booked, it shall refund that proportion of the monies paid that the period re-let bears to the original booking less Booking Fee, Insurance Premium and a handling charge of 25 Pounds (plus VAT). If the Company shall be unable to re-let the holiday accommodation at all then all monies paid by the Holidaymaker (whether by deposit or otherwise) due to the Owner, shall be forfeit to the Owner and the Owner shall be entitled to recover the balance of any monies owed. For this reason we have arranged Holiday Cancellation, Curtailment and Emergency Insurance. 6. Limitation of Liabilities The Holidaymaker shall be entitled to the protection afforded him by the unfair Contracts Terms Act of 1977 and accordingly nothing in these conditions shall exclude or restrict any liability which under subsections 2(1), 6(1), or 7(2) of that Act cannot in the relevant circumstances be excluded or restricted. Subject to subsection 2(1) of the said act where loss or damage arises from negligence, misrepresentation or otherwise neither the Company nor its employees or agents shall be under any liability to the Holidaymaker or to any third parties for any loss or damage howsoever arising. The Owner is wholly responsible for the factual accuracy of the published details of the holiday accommodation supplied and the Company accepts no responsibility therfor. The Owner shall have no liability for any personal injury or death, unless it has resulted in the negligence of the Owner or that of any employee of the Owner (providing that they were at the time acting in the course of their employment). The holidaymaker must take all necessary steps to safeguard his/her property. No liability is accepted by the Owner in respect of damage to, or loss of, such personal property except, where the damage or loss is caused by the negligence of the Owner or that of any employee of the Owner (providing they were at the time acting in the course of their employment). 7. Warranties The Company does not warrant and is not responsible for the accuracy of any verbal information given as statements made by it's employees or agents. 8. Ownership of The Holiday Accommodation The Company does not own or operate the holiday accommodation which it books on behalf of the Holidaymaker and accordingly its use is subject to the Terms and Conditions of the Owners. 9. Alterations to Brochures The information contained in brochures is believed accurate at the time of publication. However the Company reserves the right to make alterations thereto and the Company shall endeavour to inform the Holidaymaker of such alterations. If the alterations prove unacceptable to the Holidaymaker then alternative accommodation will be arranged or a full refund of monies paid will be given. 10. Number of Persons Using The Holiday Accommodation The number of persons using the holiday accommodation shall not exceed the maximum number publicised by the Company. The Owner is entitled, for Health and Safety reasons to ask the Holidaymaker to leave, without refund, if this condition is broken. The Owner reserves the right to refuse bookings from parties which in his/her opinion, might be unsuitable for the holiday accommodation concerned. 11. Possession Holidaymakers must not assign or part with the possession of the holiday accommodation or any part of it, or anything contained within it or use it other than as a single dwelling for holiday occupation by the people whose names appear on and for the dates detailed on the booking form. 12. Pets One pet dog is permitted only in those properties stated in the company literature - to accept dogs. Dogs must not be left unattended inside the holiday accommodation or be allowed on the furniture or in bedrooms. In consideration of subsequent holidaymakers, removal of dog fouling from garden areas is essential. The Owner can ask you to leave, with no refund if these conditions are broken. Please remember to keep dogs on leads near livestock. Neither the Company nor Owner are liable for accidents/injuries or death of pets during the period of the booking. We regret cats/caged animals or birds are not permitted. 13. Access The Owner or his/her representatives shall be allowed access to the holiday accommodation at any reasonable time during the holiday occupancy. 14. Repair The Holidaymaker shall keep the holiday accommodation and all furniture, fixtures, fittings and effects in or on the holiday accommodation in the same state of repair as at the commencement of the holiday, and shall leave the holiday accommodation in the same state of cleanliness and general order as it was found. If the Holidaymaker has concerns these should be raised with the Owner at the start of the holiday. 15. Breakages or Damage The Holidaymaker is legally bound to reimburse the Owner for replacement, repair or extra cleaning costs on demand. 16. Complaints Whilst every care is taken to ensure complete satisfaction with your holiday accommodation, in the unhappy event of you having cause for complaint, please take up the complaint immediately with the Owner or Caretaker of the cottage during your stay - this will result in a much speedier correction of any shortcomings. We have arranged a special insurance scheme with Travel Insurance specialists P J Hayman & Company Ltd to cover clients booking through us. This insurance is underwritten by ELVIA Travel Insurance International N.V. (Netherlands). Mondial Assistance (UK) Ltd is the Underwriters UK administrator and is authorised and regulated by the Financial Services Authority (FSA). ELIVA is authorised by De Nederlandsche Bank (DNB) and regulated by the FSA for conduct of UK Business. UK Plus Insurance - Premium Per Party - 17.00 Pounds per week. The following is a summary of cover only and does not contain the full terms and conditions of the contract. Full terms, conditions and exclusions can be found in the certificate of insurance, which you should read carefully. 1. HOLIDAY CANCELLATION COVER - Up to the cost of your holiday. Insurers will reimburse your irrecoverable pre-booked accommodation charges if the holiday is necessarily and unavoidably cancelled due to a cause outside your control (excess 40 pounds per party - other than loss of Deposit claims 15 pounds per party) 2. HOLIDAY CURTAILMENT COVER - Up to the cost of your holiday. Insurers will reimburse the proportion of your holiday costs that are lost following abandonment of the holiday on written medical grounds. The following cover applies under this section if the insured person is hospitalised more than 25 miles away from usual place of residence: ~ Medical Repatriation & Other Expenses - Up to 25,000 Pounds (Excess 40 Pounds per Party) 3. PERSONAL COVER ~ Personal Liability - Up to 2,000,000 Pounds (Excess 100 for Holiday Accommodation Damage) ~ Personal Possessions - Up to 1,500 Pounds (Money Limit 250, Single Article 250, Excess 40 per person) ~ Personal Accident - Up to 10,000 Pounds (if under 75 years old) ~ Additional Expenses as follows Travel Delay over 6 hours - Up to 30 Pounds Polluted Beaches - Up to 150 Pounds (30 per day) Catastrophe Cover - Up to 1,000 Pounds Holiday Disruption - Up to 1,000 Pounds The Policy Excess Under Section 1 is increased to 80 Pounds per party & Section 2 is increased to 80 pounds per person if the claim is due to a pre-existing medical condition. Note: HEALTH CONDITIONS - Whilst this insurance is not subject to a health warranty, all claims are excluded where at the time of taking out this insurance: 1. (i)The insured person is aware of any set of circumstances, which would reasonably be expected to give rise to a claim. (ii)Has suffered from a chronic or recurring illness during previous 12 mths UNLESS permission is obtained from the treating GP for fitness to travel at the time of booking. 2. The person whose condition gives rise to the claim: (i) Is receiving, or on a waiting list for treatment in a hospital or nursing home; or (ii) Is awaiting results of tests; (iii) Is expected to give birth before, or within 14 weeks of, the date of arrival home; or (iv) Is travelling against the medical advise of a Medical Practitioner or for the purposes of obtaining medical treatment abroad; or (v) Has been given a terminal prognosis. Our aim is to safeguard our users' privacy whilst providing a personalised and valuable service. Collecting personal information is necessary if we are to satisfy the expectations and requirements of our users. We appreciate that you do not want the personal information you provide to us distributed indiscriminately to other parties - here we explain how we collect information, what we do with it and what controls you have. We collect two kinds of information about our users: a. non-personal information such as cottage selected, dates of preferred holiday, where you first heard about our company etc. This information doesn't tell us about who you are or where you live, it simply allows us to deliver our services to you and improve our service. b. personal information such as name, postal address, telephone number, e-mail address, card or bank details etc. We collect this information only in connection with specific requests or cottage bookings activities. The information is needed to fulfil your request or to enable us and the cottage owners to provide you with a personalised service. You don't have to disclose any of this information to browse our websites, however, if you do choose to withhold requested information, we may not be able to provide you with certain services. Any personal data relating to you will be used and recorded by us in accordance with current data protection legislation and this Privacy Policy. We will use the information you provide to: - fulfil your requests and process sales transactions, - record any contact we have with you; - we may at times share these details with the cottage owners, - provide you with information which we think may be of interest to you, as explained below.
